What changed in Portugal’s residence law in 2026?
The Foreigners Act should not be read as though every article had been replaced. The recent amendment changes identified provisions. To understand its relevance, first find your permit category, the article recorded in your file and the stage of the procedure. Then compare the underlying provision with the wording introduced by the newer law. This is more reliable than applying a headline about immigration to every residence situation.
There is a practical complication: the consolidated Diário da República text consulted is marked as being updated. That does not suspend the published amendment. It means a quick search of the consolidation may display older wording. The cards below distinguish the confirmed commencement of the amendment from this limitation of the consolidated presentation.

|---|---|
| Law | Compare the amended provision with the underlying law; do not rely only on an updating consolidation. |
| Period | Distinguish application, decision, appointment and document delivery before calculating a period. |
| Renewal | Check the provision governing the application; do not assume automatic approval through silence. |
| Work | Identify the permit category before applying an employer-change rule to your situation. |

Last checked:What is the residence-permit decision period?
A legal decision period is not a promise of an immediately available appointment or a guaranteed date for receiving a card. Keep evidence of the application, its procedural category and any notifications. A screenshot of an unsuccessful booking attempt describes a different event from proof that an application was actually submitted. That difference matters when you explain a delay.
Before challenging a delay, assemble a documentary timeline: submission, payment where relevant, requests for further information, your replies and any notice extending the period. Do not turn the number in the statute into a universal countdown. Other periods in the regime and the events in the particular file may affect an individual assessment.
Article 82(5) sets 90 days for a residence-permit grant decision, subject to other statutory periods; an exceptional justified 30-day extension requires the applicant to be informed.
Last checked:Renewal and silence: avoid an automatic conclusion
The repeal identified in the fact card concerns a particular renewal provision. It does not establish that any administrative silence grants residence, or that every tacit decision mechanism in other regimes has disappeared. EU long-term resident status, for example, has its own provisions requiring separate consideration rather than a rule copied from a different procedure.
If your card has expired, establish the renewal position and retain the relevant evidence instead of assuming that time alone created a new document. A pending application, a continuing right of residence and a currently valid card are different matters. This distinction helps explain your position when an employer, bank or public service requests current evidence.
Law 62/2026 repealed Article 82(7), the renewal provision on approval in the absence of a decision. This does not mean every special tacit-approval regime was repealed.
Last checked:A refusal: read the complete notification
Pay attention to the content of a refusal and how it was received. Save the complete notice, including its reasons, case reference and information about challenging the decision. A third-party summary cannot replace that document: the available remedy and stated deadline must be considered in the context of the actual notification and procedure.
This guide does not calculate an appeal deadline or choose litigation strategy. Seek individual advice with an organised file if the decision affects your stay or family unity. A useful first step is to distinguish a final decision from a request for clarification or additional documents. They are different procedural events, even if both appear as messages in the same inbox.
New Article 82(8) requires refusal notification to state reasons, the right to judicial challenge and its deadline.
Last checked:Changing work: identify the permit category
Read the employer-change amendment alongside the provision governing your authorisation. Someone holding an employment residence permit should not treat it as universal permission for every activity or every residence category. The same care applies to changing the nature of a self-employed activity. Category-specific rules remain relevant to understanding what the amendment actually addresses.
Prepare your permit details, the contract or other evidence of the change and a clear description of the situation. This is an editorial preparation list, not an official mandatory attachment list. A provision dispensing with a new card does not eliminate the notification required by that same provision. Keep the legal obligation separate from the practical submission method.
Article 88(8) allows a work-permit holder to change employer by notifying AIMA, without a new card. Article 89(6) also allows notification of a change in the nature of self-employed activity without a new card.
Last checked:What to do next and what remains unverified
Before using a form, establish that its option actually corresponds to the new notification and your authorisation category. Do not choose an approximately similar subject simply to upload documents somewhere. Retain the official instructions followed and delivery confirmation, while recognising that an automated reply does not show that the authority accepted the substance of the case.
Use the sources attached to each fact when checking future changes. An asylum rule, a residence amendment and a portal instruction can appear in the same law or publication while having different scopes. We will update the operational question below when a sufficiently specific channel can be verified. Its review status is a research limitation, not a claim that no instructions exist anywhere.
This review did not confirm a complete specific AIMA operational channel for notices under new Articles 88(8) and 89(6). Confirm it with the Agency.
